Apple App Store Custom End User License Agreement (EULA) Addendum

This Custom EULA Addendum supplements the standard Licensed Application End User License Agreement provided by Apple Inc. This agreement is between the end user ("Licensed Practitioner") and ARCA VISION LABS LLC, Austin, Texas 78748 ("Licensor") for the Oye Scribe application.
1. Scope of License & Professional Restriction
This software is licensed exclusively to licensed, certified medical professionals and healthcare entities. It is explicitly prohibited for use by consumer patients or for self-diagnosis.
2. Absolute Waiver of Clinical Liability
Oye Scribe is an administrative workflow documentation tool. It does not practice medicine, render clinical advice, or provide medical diagnoses. Licensed Practitioner retains sole, final, and absolute legal and clinical responsibility for reviewing, editing, and verifying the accuracy of all text summaries, transcripts, and notes generated by the application before entering them into an Electronic Health Record (EHR) system. Licensor is not liable for any clinical errors, diagnostic inaccuracies, medical malpractice claims, or patient harm resulting from the use of the software.
3. Local Hardware Security and Lost Device Disclaimer
Oye Scribe operates on an offline-first architecture; all transcription and summaries are processed locally and stored with encryption on the user's device.
- Licensed Practitioner acknowledges that Licensor has no remote access to local device data and cannot lock, recover, or wipe data.
- Licensor is entirely exempt from liability for any data breaches, unauthorized data exposure, or HIPAA privacy rule violations resulting from lost, stolen, unlocked, or compromised iOS devices.
- Licensed Practitioner is solely responsible for implementing biometric locks (Face ID/Touch ID) and strict passcode protocols on their host hardware.
4. Governing Law
Any disputes arising from this license or the use of the Oye Scribe application on iOS hardware shall be governed by the laws of the State of Texas, with exclusive jurisdiction in the state and federal courts of Austin, Travis County, Texas.
